A divorce is usually categorized as either contested or uncontested. For a divorce to be considered uncontested divorce the following items need to have been discussed and agreed upon:

  • The parties have agreed upon divorce.

  • The parties have agreed on how to divide their assets.

  • If there are minor children involved, the parties have decided:

    • With which parent the children will live,

    • Access to the children,

    • Maintenance and medical expenses.

In South Africa the divorce process is uncomplicated. Divorces can be lodged in the High Courts of South Africa or the Regional Court of the Magistrates Court that has jurisdiction over your area. A court may grant a decree of divorce on the ground of the irretrievable breakdown of a marriage if it is satisfied that the marriage relationship between the parties to the marriage has reached such a state of disintegration that there is no reasonable prospect of a normal marriage relationship between them or on the ground of the mental illness of the defendant.

A SUMMARY OF THE DIVORCE PROCESS

  • Divorce Legal will draw up the documents to be signed by both parties.

  • Divorce Legal will issue the summons and annexes at the court.

  • The Registrar of the court will open a file, stamp the documents, and allocate a case number.

  • Divorce Legal will courier the original documents to you together with a step-by-step guide where after you will arrange with the Sheriff in the area to serve the documents on the defendant personally. You will pay the Sheriff’s fee of approximately R150 to R250 and courier the original documents together with the Sheriff’s return of service to Divorce Legal.

  • If there are minor children involved, the parenting plan will also be endorsed by the office of the Family Advocate.

  • The parties will wait for a period of 10 to 20 days depending on the parties’ jurisdiction where after Divorce Legal will obtain a date for the hearing of the matter.

  • Divorce Legal will submit to the court a notice of a set down together with the documents and notify the parties of the date of the hearing

  • On the date of the hearing, the plaintiff will appear personally in court, without legal representation, before the judge or magistrate to conclude the divorce

  • Divorce Legal will uplift the divorce order in the event that the court grants a decree of divorce approximately 2 weeks after the hearing

  • Divorce Legal will deliver the divorce order to the parties
